This document (together with all documents referred to herein) sets out the terms and conditions governing the use of this website – www.craterflame.at (hereinafter the “Website”).
The purpose of the Website is to present and promote the products manufactured by the company SC FERROBEN METALDESIGN SRL and to sell them through the Website to potential customers interested in these services.
Please read these General Terms and Conditions, the Cookie Policy, and the Privacy Policy before using the Website. By accessing and using the Website, you expressly acknowledge the binding nature of these documents and agree to comply with them.

DEFINITIONS

1. Seller – FERROBEN METALDESIGN SRL
2. Buyer – can be any natural person over 16 years old, or a legal entity, or any legal unit that creates an account on the Website and places an order.
3. Customer – can be any natural person over 16 years old, or a legal entity, who has access to CONTENT through any communication means provided by FERROBEN METALDESIGN SRL (electronically, by phone, etc.) or based on an existing usage agreement with FERROBEN METALDESIGN SRL and requiring or enabling account creation or using the quick order feature.
4. Account – the area of the Website consisting of an email address and password, enabling the buyer to submit orders, containing information about the customer/buyer and their order history on the Website (orders, invoices, product warranties, etc.). The user is responsible for ensuring that all information entered during account creation is correct, complete, and up to date.
5. My Cart – the section within the account allowing the buyer/user to add products they wish to purchase now or later;

8. Order – an electronic document serving as a communication form between seller and buyer, through which the buyer informs the seller of their intention to purchase products via the Website;
9. Products – any product listed on the Website, including those mentioned in the order, to be delivered by the seller to the buyer under the concluded contract.
10. Campaign – an action offering a limited number of goods and/or services with a defined stock for a limited period set by the seller for commercial purposes.
11. Contract – a distance sales contract concluded between seller and buyer without the simultaneous physical presence of both parties.
12. Review – a personal evaluation of a product owner or beneficiary, based on their experience using the product, indicating whether it meets the seller’s specifications. Each review may include a rating sent via email to the manufacturer.
13. Commercial communications / Newsletter – any message (email, phone, mobile push, web push, etc.) containing general and thematic information, information on similar or complementary products to those purchased on the Website, offers or promotions, or products added to the account/cart/favorites.

GENERAL TERMS
3.1. By placing an order on the Website, the buyer expressly agrees to the communication method (phone or email) used by the seller for conducting business.
3.2. All products sold on our WEBSITE are original and delivered in the appropriate packaging, accompanied by an invoice according to applicable law.
3.3. Product images on the Website are for informational purposes. For more details, please contact us regarding product specifications or additional information.
3.4. Product prices are displayed in Lei on the Website and include VAT. Prices do not include shipping. Prices may change without prior notice. Buyers always pay the prices existing at the time of the order for confirmed orders.
3.5. Placing an order by the buyer and its acceptance by the seller constitutes the conclusion of a contract under applicable law. The email notification received immediately after placing the order serves as information and REPRESENTS THE ORDER CONFIRMATION.
3.6. The contract is considered concluded when the buyer receives notification of the order shipment by email. Ownership of the ordered products transfers when the order arrives and the buyer fulfills their payment obligation.
3.7. The seller may refuse or cancel an order if it was placed by a person showing hostile behavior that may harm the seller. In such cases, the buyer may contact the seller for reasons for the actions taken.
3.8. The seller may, for valid reasons, change the quantity of products in an order. The buyer will be informed via the provided email or phone number, and any overpaid amount will be refunded.
3.9. All information on www.craterflame.at is intellectual property of SC Ferroben Metaldesign SRL under copyright law (Law No. 8/1996). All content (text, product descriptions, images, logo, colors, slogans, symbols, web graphics, video clips, etc.) may only be used to inform users and buyers.
3.10. Photos edited or processed by SC Ferroben Metaldesign SRL on the WEBSITE may not be used without permission;
3.11. S.C. FERROBEN METALDESIGN S.R.L is not responsible for color differences displayed on various devices (desktop/tablet/mobile).
3.12. Any action: project, event, campaign, competition, service, etc., carried out by the company on the Website will be announced and detailed at the time of execution through rules or clear terms included in the announcement or later at the appropriate time.
3.13. The seller reserves the right to change, modify, or update the content of the WEBSITE www.craterflame.at and its terms of use at any time without prior notice.
3.14. Copying, distributing, publishing, transferring, or integrating content outside the Website www.craterflame.at without consent is strictly prohibited and punishable by law.

ACCESS TO WEBSITE
4.1. Access to the Website is only via the public domain: www.craterflame.at.
4.2. By accessing and using www.craterflame.at, the user/customer accepts the terms, privacy policy, and cookie policy presented on the WEBSITE.
4.3. Users/customers have limited access for personal purposes (viewing, information, placing online orders) and may not download, modify, reproduce, copy, sell/resell, or otherwise use the WEBSITE contrary to SC Ferroben Metaldesign SRL’s interests.
4.4. Communication with the seller can occur via direct interaction, including online support (technical advice) or through the addresses listed in the “Contact” section. The seller may manage information freely without justification.
4.5. All information describing available products/services on the Website (static/dynamic images/multimedia presentations/etc.) is for presentation purposes only and not a contractual obligation.
MY ACCOUNT
5.1. Any user over 16 years old meeting the legal conditions for purchasing products may create an account on www.craterflame.at.
5.2. Creating an account allows faster ordering, as all data is pre-entered. Account holders may also subscribe to newsletters for offers and benefits communicated by SC Ferroben Metaldesign SRL.
5.3. By creating an account, users agree to these terms, acknowledge the privacy and cookie policies, and are responsible for providing accurate and updated information.
5.4. Steps to create an account:

• Enter personal data: first name, last name, email, phone (if applicable);
• Enter a password and confirm it;
• Check the box to accept terms;
• Check the box to acknowledge privacy policy;
• Optionally subscribe to the newsletter;
• Press “CREATE” to complete account creation.

In the account, you can:

• Edit account info: name, email, phone
• Change account password
• Change delivery address for orders
• Edit the wishlist

You can also view orders and other activities on www.craterflame.at, including newsletter subscription.
CONTRACT SUBJECT
6.1. The contract concerns the sale of goods ordered by the buyer on the Website. The contract is concluded when the seller accepts the order and sends shipping notification.
6.2. Ownership transfers when the order arrives at the buyer’s address, payment is made, and acceptance is signed on the courier document.
6.3. The seller includes necessary documents proving the purchase in the package sent to the customer/buyer.
ORDER
7.1. Customers can place orders by adding products/services to the cart and completing the order with a minimum of 500 Lei. Adding products without completing the order does not reserve them.
7.2. By completing the order, the buyer confirms all provided data is accurate at the time of ordering.
7.3. The buyer agrees the seller can contact them via any agreed method if needed.

7.5. Order cancellation: The seller may unilaterally cancel an order if:

• Data provided by buyer is incorrect or incomplete;
• Transaction not accepted by buyer’s card-issuing bank;
• Transaction not validated by seller’s agreed processor;
• Buyer has more than two consecutive failed deliveries for reasons beyond seller’s control;
• Buyer’s activity could harm the seller;
• Suspicious transaction flagged by a bank, institution, or authority;
• Other objective reasons exist.

The buyer may cancel an order if:

• Contacted by company representative and no longer wants the products;
• In writing via info@craterflameat.at or by phone before receiving email confirming courier delivery to the buyer’s address.
